A man accused of hurtling down a Saskatchewan highway at more than 190 kilometres an hour is off the legal hook after a judge ruled the radar gun used to catch him had not been calibrated.
The February 14th written decision from Estevan provincial court was recently published online on the Canlii legal database.
Judge James Benison said in court that the R-C-M-P officer who stopped the man east of Carnduff in October 2011 had not calibrated the gun as required before going on shift.
The judge also said a certificate showing the equipment was in good working order appeared to be for a different model altogether.
